Terms & Conditions

By downloading, installing, accessing, or using the Joharr And Joharr Sarthi mobile application or website at joharcab.com ("the Platform"), you ("User," "You," or "Your") agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and any other policies or guidelines we publish from time to time.

If you do not agree with any part of these Terms, you must immediately stop using the Platform and uninstall any application.

Joharr And Joharr Sarthi ("the Company," "We," "Us," or "Our") operates solely as a technology intermediary and booking facilitation platform. Our role is strictly limited to:

• Accepting cab booking requests from users via the app or website.
• Connecting users with independent drivers who are registered on the Platform.
• Facilitating communication between users and drivers for ride confirmation.

Joharr And Joharr Sarthi explicitly does not:

• Own or operate vehicles — We have no fleet of any kind.
• Employ drivers — All drivers are independent individuals, not our employees, agents, or contractors.
• Track real-time location — We do not access or store GPS or location data of users or drivers.
• Process payments — All fare payments are made directly between customer and driver. We do not handle any financial transactions.
• Set or guarantee fares — Pricing is agreed independently between the customer and driver.
• Guarantee ride availability — We cannot guarantee that a driver will always be available for every booking request.

For Customers

• You must be at least 18 years of age.
• You must provide accurate and truthful information during registration.
• You must have a valid mobile number accessible in India.
• You must have legal capacity to enter into a binding agreement under Indian law.

For Drivers

• You must be at least 18 years of age.
• You must hold a valid Indian driving licence appropriate for the vehicle you intend to operate.
• Your vehicle must have valid registration, commercial/taxi permit (where applicable), fitness certificate, and motor vehicle insurance.
• You must comply with all applicable state and central transport laws, including those of Jharkhand.
• You are solely responsible for your own regulatory compliance.

To use certain features of the Platform, you may be required to register for an account. By creating an account, you agree to:

• Provide accurate, complete, and current information during registration.
• Maintain and promptly update your account information.
• Keep your login credentials confidential and not share them with any third party.
• Be solely responsible for all activity that occurs under your account.
• Notify us immediately at manoj@joharcab.com if you suspect any unauthorised use of your account.

We reserve the right to suspend or delete accounts that provide false information, violate these Terms, or are inactive for an extended period.

When you submit a cab booking request through Joharr And Joharr Sarthi:

• Your request is broadcast to available independent drivers registered on our Platform.
• A driver who accepts your request will contact you directly (typically by phone call) to confirm the ride details.
• The ride is confirmed only when both you and the driver mutually agree to the fare, pickup time, and destination.
• Joharr And Joharr Sarthi is not a party to this agreement between you and the driver.

Cancellations

Cancellations are handled directly between the customer and the driver. Joharr And Joharr Sarthi is not responsible for any disputes, inconveniences, or losses arising from a cancelled booking. Please refer to our Refund Policy for more information.

By registering as a driver on Joharr And Joharr Sarthi, you acknowledge and agree that:

• You are an independent service provider, not an employee, agent, or contractor of Joharr And Joharr Sarthi.
• You are solely responsible for complying with all applicable motor vehicle laws, state transport regulations, RTO permits, and other legal requirements.
• You will maintain valid driving licence, vehicle registration, insurance, fitness certificate, and any other required documentation at all times.
• You will treat all customers with courtesy and professionalism.
• You will not misrepresent yourself or your vehicle to any customer.
• You will not demand or accept payments through Joharr And Joharr Sarthi — all payments are your sole arrangement with the customer.
• Joharr And Joharr Sarthi reserves the right to remove you from the Platform at any time for any reason, including customer complaints or violation of these Terms.

Joharr And Joharr Sarthi does not handle, process, or intermediate any payments. All financial transactions are strictly between the customer and the driver.

• No in-app payments: Joharr And Joharr Sarthi does not have any payment gateway, wallet, or in-app payment feature.
• Fare agreement: The fare for each ride is negotiated and agreed upon directly between the customer and the driver.
• Payment disputes: Any disputes about fares or payments are solely between the customer and the driver. Joharr And Joharr Sarthi has no liability for such disputes.
• No commission: Joharr And Joharr Sarthi does not charge drivers or customers any commission or service fee through the Platform at present (subject to change with prior notice).

You agree not to use the Platform to:

• Submit false, misleading, or fraudulent booking requests.
• Harass, threaten, or abuse any driver, customer, or Joharr And Joharr Sarthi representative.
• Reverse-engineer, decompile, or attempt to extract the source code of our application.
• Use automated bots, scripts, or tools to access or scrape the Platform.
• Violate any applicable Indian law, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
• Engage in any activity that disrupts or interferes with the operation of the Platform.
• Impersonate any other person or entity.

We reserve the right to investigate and take appropriate legal action against anyone who violates these terms, including banning their account and reporting to law enforcement.

To the fullest extent permitted by applicable law, Joharr And Joharr Sarthi, its directors, officers, employees, and agents shall not be liable for:

• Any accident, injury, loss, or damage occurring during a ride facilitated through our Platform.
• Driver conduct, behaviour, or actions during or outside a ride.
• Vehicle condition, roadworthiness, or mechanical failure of any driver's vehicle.
• Non-availability of drivers at any particular time or location.
• Payment disputes between customers and drivers.
• Any loss of data, revenue, or profits arising from use of the Platform.
• Any indirect, incidental, special, or consequential damages of any kind.

Our total liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed ₹500 (Indian Rupees Five Hundred Only).

All content, design, code, trademarks, logos, and materials on the Joharr And Joharr Sarthi Platform are the exclusive intellectual property of Joharr And Joharr Sarthi or its licensors and are protected under applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes only. You may not:

• Copy, reproduce, distribute, or create derivative works from any Platform content.
• Use the Joharr And Joharr Sarthi name, logo, or branding without our prior written consent.
• Remove any copyright, trademark, or proprietary notices from Platform materials.

You may terminate your account at any time by submitting an account deletion request through our Account Deletion Request Form. We will process deletion requests within 30 days.

Joharr And Joharr Sarthi reserves the right to:

• Suspend or terminate your account at any time, without notice, if you violate these Terms.
• Remove any driver from the Platform at our sole discretion.
• Discontinue the Platform or any part of it at any time.

Upon termination, your right to use the Platform immediately ceases. Provisions that by their nature should survive termination (including liability limitations, intellectual property rights, and governing law) will remain in effect.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

• Jurisdiction: Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in Jharkhand, India.
• Informal Resolution: Before initiating any legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at manoj@joharcab.com. We will attempt to resolve disputes within 30 days.
• Applicable Law: These Terms are subject to the Information Technology Act, 2000; the Consumer Protection Act, 2019; and the Digital Personal Data Protection Act, 2023, as applicable.

We may update these Terms from time to time. When we do, we will:

• Post the updated Terms on this page with a revised "Effective" date.
• Notify you via email or a prominent in-app notice for material changes.

Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and delete your account.
